§ 42-288. Appeal procedure.
(a)
Any applicant shall have the right to appeal the denial of a parade or public assembly permit to either the City Council or the Mayor. The choice of forum shall be at the option of the applicant. The denied applicant shall make the appeal within five (5) days after receipt of the denial by filing a written notice with the Chief of Police and a copy of the notice either with the City Legislative Assistant, with respect to appeals to the City Council, or with the Mayor. The City Council or the Mayor shall act upon the appeal within forty-eight (48) hours following receipt of the notice of appeal.
(b)
In the event that the City Council or the Mayor rejects an applicant's appeal, the applicant may file an immediate request for review with a court of competent jurisdiction.
