§ 48-214. Inspections.

  • (a)

    An agent shall have free and unobstructed access to any part of the premises for the purpose of inspecting the installation, operation and maintenance, best management practices of any and all pretreatment requirements of the food preparation establishment.

    (b)

    Inspections may be unscheduled and may occur any time of the day between scheduled business hours or at any other time of day in the event of an emergency. If such entry is refused, the FPE and or property owner is subject to fines and penalties set forth in violation schedule. The service may be suspended immediately in the event of an emergency if there is reasonable cause to suspect that the discharge will endanger the public health or the environment, shall have the potential to disrupt the POTW treatment process, or shall damage the POTW mains or facilities. A hearing shall thereafter be afforded the owner of the FPE, as soon as possible.

    (c)

    The FPE owner shall designate a contact person under this division. The contact person must have a reasonable working knowledge of the FPE and the requirements defined by this division. The contact person must provide the authorized agent with contact information for both normal business hours and after-hours, in case of an emergency.

    (d)

    Unreasonable delays in allowing the inspector access to the FPE's premises shall be a violation of this division.
