§ 48-104. Criteria for determination of assessment.

  • The City Council shall assess the benefits of each extension based upon the following criteria:

    (1)

    Area of the property benefited.

    (2)

    Frontage of the property, benefited.

    (3)

    As to residential property, the present permitted zoning classification of the property benefited, including the existing number of units thereon or the number of units allowable under zoning regulations, whichever is greater. As to property zoned commercial or industrial, a unit shall constitute for purposes of this division an area of five thousand (5,000) square feet; any commercial or industrial property of less than five thousand (5,000) square feet which contains or can be permitted to contain a lawful use, shall be deemed to contain five thousand (5,000) square feet for the purpose of this division, and any commercial or industrial property containing more than five thousand (5,000) square feet, to the extent that such excess over five thousand (5,000) square feet does not constitute a full unit as set forth herein, shall be assessed based upon the percentage that such excess bears to a full five thousand-square-foot unit.

    (4)

    The grand list valuation of the property benefited, including both land and buildings.
