§ 42-89. Excavations in grass areas.

  • (a)

    Excavations in grass areas shall be backfilled and compacted in the manner previously described. The upper six (6) inches of the backfill shall contain loam or topsoil which shall be loose and friable and free from sticks, roots, rocks, rubbish, weeds or any other substance that will interfere with the formation of suitable grass cover. The loam shall be placed and raked so as to flush with the surrounding surfaces. In the event settlement takes place, additional material shall be added so as to keep the surface reasonably even.

    (b)

    After settlement is complete, the permittee shall sow grass seed at a rate of not less than one-half (½) pound per one hundred (100) square feet. The grass seed shall be similar or equal in purity, germination and seed varieties by weight of the standard quality of "Red Seal Mix". Fertilizer shall be applied at the rate of three (3) pounds per one hundred (100) square feet and shall be of a commercial type, derived from organic sources and shall have percentages by weight of nitrogen, phosphoric acid and potash of 5-8-7, 10-6-4 or 5-10-5.

    (c)

    Seeding shall be permitted in the spring and fall only, unless otherwise authorized by the Superintendent of Highways.

    (d)

    It shall be the permittee's responsibility to re-establish grass areas disturbed by him until such time as dense growth is attained with a height of approximately three (3) inches.
