§ 42-85. Maintenance of temporary repair during period of settling.

  • Depending upon the character of the excavation, the depth, the kind of material used in backfilling, the degree of compactness obtained and other conditions, the Superintendent of Highways may require that the temporary repair of an excavation be maintained until he is satisfied that the settlement of the backfill material is, for all practical purposes, complete and that the permanent repair can be made without creating a hazard to highway users. Upon approval by the Superintendent of Highways, the permittee shall make the permanent repair within a period of two (2) weeks.
