§ 32-78. Recall.

  • Whenever a regular member of the Danbury Fire Department has been retired and is eligible for pension benefits pursuant to the provisions of either section 32-71 or 32-72 relating to disability pensions, but excluding those whose disabilities were established pursuant to the provisions C.G.S. § 7-433c, the Board of Directors of the 1967 Danbury Firefighters Pension Fund may cause said person to be re-examined by two (2) physicians selected by the board. If such retired member of the Danbury Fire Department is found to be able to return to active firefighting duties said board may terminate the payment of pension benefits to him and order his return to active service with the Danbury Fire Department. Upon reinstatement pursuant to this section, any such person shall be returned to his former classification without loss of seniority or benefits. The provisions hereof shall not apply to any employee or former employee who is over fifty-five (55) years of age or who, but for his disability, would otherwise have completed twenty-seven (27) years of service with the Danbury Fire Department.
