§ 20-172. Minimum thermal standards.

  • No person shall occupy as owner, occupant or let to another for occupancy any dwelling or dwelling unit, for the purpose of living therein, which does not comply with the following requirements:

    (1)

    Every dwelling or dwelling unit shall be supplied with heating devices which are properly installed, are maintained in safe and good working condition, and are capable of safely and adequately heating all habitable rooms, bathrooms, and water closet compartments located therein to a temperature of at least sixty-five (65) degrees Fahrenheit at a distance three (3) feet above floor level when outdoor temperature is ten (10) degrees Fahrenheit below zero.

    (2)

    In every dwelling unit and/or rooming unit when the control of the supplied heat is the responsibility of a person other than the occupant, a temperature of at least sixty-five (65) degrees Fahrenheit shall be maintained in all habitable rooms, bathrooms, and water closet compartments at a distance of three (3) feet above the floor level at all times.

    (3)

    The heating devices provided shall be equipped with a control valve and/or thermostat to allow the occupant of the dwelling or dwelling unit to regulate and/or reduce the heat supplied.

    (4)

    No owner or occupant shall install, operate or use an unvented space heater employing a flame.
